Swimming Pool Inspection Policy

The Swimming Pools Act 1992 was amended in 2012 to introduce new requirements for pool owners to register their pools, including spa pools, on a central on-line facility developed by the Division of Local Government.

As part of these new arrangements Council has developed a Swimming Pool Inspection Program in consultation with the local community. This Program, which has been adopted by Council in March 2014, is available by following the Inspection Program link, or by obtaining a copy from Council’s Green Street Office.

Please Note: Local councils are the relevant regulatory authority under the provisions of the Swimming Pools Act. While the swimming pool database will be maintained by the Division of Local Government, councils have a role in ensuring compliance with the Act, the issuing of certificates in relation to swimming pools and any required enforcement actions to make sure pool owners maintain their pools in accordance with the Act.

 
Swimming Pool Register

In 2013, the NSW State Government introduced the Swimming Pool Register. All property owners in NSW that have a swimming pool are required to register their pool on the register, with penalties of up to $220 for those that fail to do so. After registration, a certificate will be issued for that pool, which is to be recorded for future reference.

The register allows regulative authorities, including Councils, to keep record of all pools in NSW, while monitoring their level of compliance with the relevant Australian standards as defined by the Swimming Pools Act 1992.

Swimming Pool Compliance

From 29 April 2016, no property in NSW with a swimming pool may be sold or leased without the pool having a valid certificate of compliance or a relevant occupation certificate. The certificate of compliance, which may be sought from Council, identifies the pool as being compliant with the safety regulation of the Swimming Pools Act 1992 (and regulations).

Once a compliance certificate has been issued, it is valid for three (3) years.
