Welcome to Lockhart Shire Council’s Building and Development Section

Lodging a Development, Construction Certificate and Section 68 Application

The NSW State Government has introduced changes that now require all Development, Construction Certificate and Section 68 Applications (e.g. transportable dwellings & septic systems) to be lodged via the NSW Government’s Planning Portal, these include:

  • Development Applications
  • Applications to modify a Development Application and
  • Where Council is nominated to complete the assessment of Complying Development Certificate, Construction Certificate, Occupation Certificate and Subdivision Certificate or is appointed as the Principal Certifier for a development.

Please be aware that separate applications are to be lodged for each certificate via the Planning Portal.

  • Certificate Registration for Private Certifiers

The NSW Planning Portal is an online platform where community, industry and government can work together to provide a digital experience that supports effective planning and decision making under the Environmental Planning and Assessment Act 1979.

DEVELOPMENT APPLICATIONS
If you are planning any major building works, including for a retail outlet, swimming pool, subdivision or dwelling, you will require development consent from Council. To gain consent, you will be required to lodge a development application (DA) through the Planning Portal.

The Development Application process in NSW can be tricky and overwhelming, so the NSW Department of Planning and Environment have provided a guide to assist you.

DEVELOPMENT-RELATED FEES
Once you have submitted a development application through the Planning Portal, payment of fees will apply.

The cost of fees is determined by a number of variables, including the estimated cost of development, and the type of development (construction, subdivision etc.).

Council will send a formal schedule of fees that will be applicable to your development.

Fees can be paid either at the Council Office during business hours, or by direct deposit (please contact Council for banking details).

LONG SERVICE LEVY
The new Levy portal – A better way to pay your Long Service Levy

As part of the ongoing commitment to improving our customer experience the Long Service Corporation has introduced a new online Building Levy portal, to make it easier to manage your long service levy payments and transactions. You will be able to:

  • Pay a levy
  • Apply for a refund
  • Request an exemption
  • Request a top-up
  • Request an instalment plan
  • Get notifications
  • Automated receipting

With more ways to pay:

The New South Wales Parliament applies a levy on building and construction work costing $25,000 and above (inclusive of GST) in New South Wales. The levy is paid into a fund administered by the Long Service Corporation, and from this fund, the Corporation makes long service payments to building and construction workers.

The current levy rate is 0.35 % of the value of building and construction works costing $25,000 or more (inclusive of GST), and can be paid along with your development application fees at the time of submission.

DEVELOPMENT CONTRIBUTIONS PLAN 2020
On 17 August 2020 Council adopted the Lockhart Shire Development Contributions Plan 2020. Formulated under Section 7.12 of the Environmental Planning and Assessment Act 1979, the Plan enables Council to charge a levy on developments as a means of funding improvements to local infrastructure and services. This new Plan replaces the previous Plan which was adopted in 2015.

PRE-LODGEMENT APPOINTMENTS
It is highly recommended that, prior to lodging your development application, you book an appointment with Council’s Planning & Environment team.

Pre-lodgement appointments are a great way to go through your application with Council’s staff, and can speed up the application process by ensuring that all supporting information is supplied together at the time of lodgement.
