Lockhart Shire Council wishes to remind residents of their responsibilities in relation to driveways and works within the public road reserve.
Property Owner Responsibility
Property owners are responsible for the maintenance of their driveway, including the section between the property boundary and the edge of the bitumen (sealed pavement), or, in the case of gravel roads, to the edge of the carriageway.
Works on the Road Reserve
If you intend to undertake works on the road reserve, approval is required under Section 138 of the Roads Act 1993. This applies to any construction, modification, or significant repair work within the road reserve area. Carrying out works without approval is an offence, and Council may issue fines or take compliance action.
Works Standards
Lockhart Shire Council has recently reviewed the Standard Conditions for Road Opening, Construction, and Maintenance Works in Public Road Reserves. A key change is that where a driveway connects to a sealed road, the driveway itself must also be sealed to the edge of the roadway.
Minor Maintenance Exception
Minor maintenance activities, such as filling a small pothole in your driveway, do not require Council approval.
